Dog purchased is presently evaluated as marked below; (evaluations will be done by breeder at 8 weeks);

Buyer agrees to care for said dog in a responsible manner;  including  (but not limited to):
     at the least; annual veterinary checks, parasite checks, vaccinations, prompt medical attention if dog shows signs of illness or injury, proper shelter (with protection from winter & summer temperatures), dog shall not be allowed to roam free,  shall be licensed in  the county of residence of  buyer,  and shall have  by the age of 9 months completed at least  _________   (number determined upon evaluation) obedience course(s).  X ______ Buyers initials .  Buyer understands that failure to abide by these guidelines or treating said dog in abusive or neglectful manner may result in repossession of said dog without recourse to buyer.
If at any time during said dog's life buyer must surrender ownership, said dog must never be sold, given away or transferred except back to seller. Any other transfer of this dog without seller's written permission shall make buyer liable for $4,000.00 in punitive damages.

Any pups produced from Canton Kennels Chesapeakes that are sold or resold to pet shops will make buyer liable for $500.00 per pup as liquidated damages.

Canton Kennels will not knowingly sell a dog which is in ill health or afflicted with a genetic or congenital defect without full disclosure of such ailment to buyer.
Seller guarantees this dog to be in good health at the time of sale. Buyer agrees to take said dog to a licensed veterinarian within 48 hours from time of purchase for a health check. If the dog is determined to be in ill health, the cause of which is clearly attributable to the seller, said dog may, upon presentation of a written diagnosis from said veterinarian, be returned for refund of purchase price or replacement excluding shipping costs, the choice of which is to be determined by seller. Buyer is responsible for the initial visit costs and any immunization shots, if given at that visit.

SHOW POTENTIAL GUARANTEE
Pups evaluated as Show Potential are guaranteed against disqualifying faults, hereditary defects and diseases. Males are guaranteed to have two descended testicles. All dogs evaluated as Show Potential are guaranteed to be free of Hip Dysplasia. If a dog should fail it's OFA at two years of age, a copy of the OFA certificate must be forwarded to seller within 30 days. All submissions to OFA  and x-ray costs are paid by the buyer/owner. Upon receipt of said OFA Certificate, seller will refund the difference of price between a Show Potential and a Companion Family Member dog, or offer a replacement upon return of said dog with its original AKC registration papers. The buyer pays all shipping costs for a replacement. Hip Dysplasia has not been proven to be solely hereditary; environmental as well as nutritional factors play a role, and are beyond control of seller. Therefore, the Hip Dysplasia guarantee is null and void unless the following conditions have been met:

  1. Diagnosis must be made before said dog is 30 months of age;

  2. Said dog must never have been used for any breeding;

  3. Buyer must follow dietary and exercise recommendations of seller.

  4. Said dog was not in any accident, never  had a self inflicted injury, stifle injuries or kept in an overweight condition.
Pups evaluated as Show Potential are guaranteed against inherited eye disorders. Should a diagnosis of such a disorder be made, seller will refund the difference of price between a Show Potential and a Companion Family Member dog, or offer a replacement upon return of said dog with its original AKC registration papers, the buyer pays for all shipping costs for a replacement. The examination from which this diagnosis is made must be performed by a certified veterinary ophthalmologist, and a copy of the report must be forwarded to seller within 30 days. Inherited eye disorder guarantee is null and void unless the following conditions have been met:

  1. Diagnosis must be made before said dog is 3 years (36 months) of  age.
  2. Said dog must never have been used for breeding.
    Seller reserves the right to obtain a second opinion,  their cost.
    ANY USE OF THE DOG FOR BREEDING BEFORE; 
  3. IT IS TWO YEARS OLD,
  4. HAS AN OFA  NUMBER AND A CURRENT CERF NUMBER,  RENDERS THE GUARANTEE NULL AND VOID

Buyer understands that in the event of a refund, return, exchange or any future diagnosis or re-evaluations that change a dog's status from Show Potential to Companion Family Member, said dog is automatically obligated to abide by ALL conditions and terms of such a dog a dog as described below. Replacement dogs are not guaranteed beyond that of a companion Family Member.

COMPANION FAMILY MEMBER
Pups evaluated as Companion Family Members are guaranteed against preventable, disabling or life-threatening diseases which would make said dog unable to function in health and comfort. If a diagnosis is made within the first 2 years of such a genetic or congenital defect, seller will refund purchase price of said dog provided:

  1. Dog is returned to seller with original AKC registration papers;

  2. Written diagnosis from licensed veterinarian is forwarded to seller within 30 days of examination;
    Seller reserves the right to obtain a second opinion, at their expense
  3. Dog must never have been used for any breeding;
  4. Buyer must follow dietary and exercise recommendations of seller.

    All pups sold as Companion Family Members are sold with Limited Registration and are required to be spayed or neutered by the age of one year. Buyer will supply seller with a certificate of spay/neuter from a licensed veterinarian within 30 days of surgery. Buyer understands that failure to meet this criteria may result in the repossession of said dog without recourse to buyer.
   If any Companion Family  Member dog is used for breeding at any time, buyer is liable for the sum of $5,000.00 in liquidated damages each time said dog is used. Such breeding will result in the repossession of said dog without recourse to buyer.

Any  dog registered without  the Canton prefix is not covered by this or any type of guarantee. Buyer agrees to all terms and conditions specified herein regarding the purchase of  said dog. Any additions to this contract shall be noted below and initialed by both buyer and seller.

If any provision of the agreement is or becomes void or unenforceble by force or operation of the law, the other provisions shall remain valid and enforceable.  The entire agreement of the parties is contained herein.
In the event of a dispute, Oregon State will have jurisdiction over the matter.
